"In another emerging revelation, another neurologist who examined the timeline of Terri’s brain scans found that for the first three days of her initial hospitalization in 1990, her brain scans were normal. Then suddenly, on the sixth day, her brain scan showed evidence of a massive injury. He concludes that Terri was hit on the head and suffered intracranial hemorrhage while in the hospital. The physician maintains that she did not suffer her brain damage outside the hospital but while she was hospitalized.
According to the physician, if the reports produced are accurate (normal CT brain on Feb. 27, injury on Feb. 25, 1990) then she did not suffer an event of massive ischemia on Feb. 25, 1990, the date of her alleged “collapse” The physician says that there is no radiologist or neurologist or neurosurgeon in the world that would dispute this as it is impossible. The CT on Feb. 27, 1990, would have been grossly abnormal."

The decision of the legislature and the governor
RAY SUAREZ: For more on this controversial case, we're joined by speaker Johnnie Byrd of Florida's House of Representatives -- he is also a lawyer -- and Kenneth Goodman, the founder and director of the Bioethics Program at the University of Miami. Speaker Byrd, why did you and your legislative colleagues in both the Florida House and Senate intervene in this case?
JOHNNIE BYRD: Well, something had gone terribly wrong with this process. The vast majority of the legislators in Florida and thousands of Florida citizens were -- completely lost confidence in this process that seemed to be replete with conflicts of interest between the husband and the best interest of this beautiful lady. So, we had to intervene to give a clear signal to the Florida courts what the legislative intent and the public policy of Florida would be in cases such as the Terri Schiavo case.
RAY SUAREZ: Professor Goodman, is there anything wrong with the legislature stepping in when it finds it can't abide a court decision, when it strenuously disagrees?
KENNETH GOODMAN: It's not merely a court decision but a series of decisions made by physicians and others over 13 years. It's been through the courts quite a bit. And it has been the topic of extensive debate during all that time. It seems to a lot of people -- and with all due respect to Representative Byrd -- I think a lot of Floridians are actually quite troubled that the idea that, in fact, this process might run its course naturally be intervened with at the last minute is actually troublesome.
We agree completely that this is a beautiful woman. She's undergone an extraordinary and difficult ordeal, but the right thing to do -- and I think the legislature while it may have believed that, was actually on the wrong side -- THE RIGHT THING TO DO IS AFTER 13 YEARS OF PERMANENT UNCONSCIOUSNESS THAT SHE BE ALLOWED TO DIE WITH DIGNITY. I think most Floridians would support that.
RAY SUAREZ: In your reading of the law, Professor, what should have happened in the years after Terri Schiavo first was diagnosed as having severe brain damage?
KENNETH GOODMAN: Well, in fact, what should have happened is I think what happened. Certainly nobody was in a hurry to deprive her of life support. It has been 13 years. A number of neurologists and others have examined her. Whenever you have a family dispute, though, this is something we try and teach our students everywhere, and I assume representative Byrd agrees, the idea that all of us should take away is make clear that your loved ones know what your wishes would be.
There's a dispute about whether or not her husband, who according to the law of Florida, would be her surrogate -- HAS SOME CONFLICT OR OTHER -- SOMETHING I'M NOT COMPETENT TO ADDRESS. Normally people want their spouses to make those decisions for them. In fact, a lot of people think that the parents of adult children actually don't make particularly good surrogates for a bunch of reasons.
End of life and legal guardianship
RAY SUAREZ: Well, what does the law say though? Has there ever been any challenge to Michael Schiavo's legal standing as his wife's guardian?
KENNETH GOODMAN: Not as such, only the allegations against him in particular. The law puts after, for example, a court-appointed guardian, the spouse of someone who is unable to speak for him or herself as the primary proxy to make those kinds of decisions. That's true in Florida. It's true in many other states.
The problem, of course, is when you have a family dispute -- and of course everyone's heart goes out to the Schiavo family -- when you have a dispute like that, courts are sometimes clumsy mechanisms for resolving it. But the best process that anyone could think of went forward and did over the last several years.
RAY SUAREZ: Mr. Speaker, is the professor right when he says that this is sort of complicated by the fact that there was no written end of life directive, that there was no document codifying Terri Schiavo's end of life wishes?
JOHNNIE BYRD: Well, certainly, Floridians as well as Americans have the right of self-determination. Yes, if there had been a written declaration in this case, this case would not be here at all. The problem is, is a very cloudy section of law. The legislators, three out of four legislators, thought that the courts had gone off on a tangent. Above all, I don't think you can cast this as just an inter-family dispute. Here we have loving parents who want to take care of their daughter -- their only daughter. And if you look at these videos, I think you cannot characterize her as being in some sort of a coma. She responds to her parents.
The testimony I think in this case was is that she could have therapy and live a higher quality of life. And It's not for us to say whether her life was worth living. We just need to err on the side of life. And I believe now with this new law, we will have another guardian ad item appointed, someone who has no conflicts of interest, you know, there were monetary incentives, I understand that Mr. Schiavo has another lady that he lives with and maybe even a child or one or more children by this other person.
And so I think to say that Terri Schiavo would like for her husband to make a decision to have her die a terrible death now -- that assumes a whole lot that I don't think the people of Florida see, nor does the legislature. I think the bottom line is we're going to stop; we're going to make sure that she has a chance to live and that hopefully her parents, who love her very much, can take care of her. And I think that a new objective guardian would be a good first step.
The legislature's deliberations
RAY SUAREZ: But in debating this bill, in writing it down and getting it through the House and Senate, were expert witnesses called to explain Terry Schiavo's brain scans, people testify on her condition, that kind of thing -- because you've expressed your impressions of the videotapes that the family has distributed.
JOHNNIE BYRD: I think that's the whole point is that, you know, the more facts that come out of this case, each fact, each excruciating fact that came from this case led to a conviction by both legislators and lay people and citizens in Florida that something terribly had gone terribly wrong with this case, that there was a lawsuit in which the husband promised that he would take care of her for the rest of her life if only he could recover these dollars.
Then, you know, after the dollars had been recovered, all of a sudden he's saying that she wanted to die. And I think that, you know, there's something to this case that is disturbing to most people as these facts came out. I think that the only thing we could do is make a decision to respect life. You know, we're talking about a human life. We don't have any second chances on this case. And slow this thing down and let's let another guardian take a look. And I think that we did the right thing. We protected life in this case.
RAY SUAREZ: But it wasn't for the legislature a medical decision, was it?
JOHNNIE BYRD: No. The legislators make public policy. I think, you know, if the step back away from this case, you know, we have three branches of government. I'll say that the legislatures have maybe, you know, delegated their authority too much to the court system. We've relied too much on the judicial system to make public policy when, in fact, the judiciary is very good at resolving disputes but very poor at making public policy.
So in this case I think some in the judiciary, some officers of the court, lawyers, have been somewhat -- had maybe apoplexy over the fact that the legislature actually stepped in and said wait a minute, the public, what we meant when we passed this statute was this and that the public policy of Florida should be in cases like Terri Schiavo, that she does have the right to life and a right to a quality of life. It is not for us to judge the quality of that life. It is for us to protect that life. And so I think what you've had is a very clear signal from the legislature as to what our legislative intent was when we passed this law.
The issue of feeding and hydration
RAY SUAREZ: Professor, you've heard the speaker refer to weaknesses in the system as it existed in adjudicating these cases. Are these matters, like for instance, his objections to the way the courts have acted in this 13-year saga a call to Florida to sort of address these so that every time there's a right to die case, it doesn't end up in the governor's lap?
KENNETH GOODMAN: Well, the question of where right to die cases should end up is itself quite an interesting one. I actually agree with Speaker Byrd that the legislature thought it was doing the right thing. Unfortunately, I think the legislature was mistaken for a number of reasons. And it's going to produce some very interesting constitutional questions that legal scholars will need to sort out. One thing that needs clarification in boldface is that the withdrawal of artificial hydration and nutrition does not produce a terrible death.
If that were the case, then Florida law and the law of 49 other states would not permit it. In fact, it's done all the time at hospitals around the country and it can be done with dignity and it can be done in a way that shows as much respect for life as anything that we can imagine. Surely no one can say that after 13 years that we've been hasty in these sorts of decisions.
In fact, a lot of reasonable people in cases where there's confusion I think would say -- this is what I hear from ordinary Floridians I speak to -- "for heaven's sakes we're really concerned about this. We want to make sure that this is not a debate about partisans trying to hustle the legislature. But now I'm worried. I mean, is there something I need to worry about -- about the refusal of hydration and nutrition?"
The answer is absolutely not. Once again there's obviously conflicting testimony in any kind of court case. But the courts ruled that the evidence before them from neurologists and other experts was that poor Terri is in a persistent vegetative state. What that means is she's not having any conscious actions or thoughts or anything else. She's not seeing. She's not hearing. And she's not feeling. Respect for life is something precious. And we all do agree that it's important for courts and legislatures to protect it.
On the other hand, the right of people to say no to burdensome treatment has also been protected heretofore by Florida statute. The concern here is a dispute about, one, whether or not the diagnosis is accurate and, two, whether or not the husband is a good surrogate or not. But as I say, I think most reasonable people, a direction by the way the Florida statute takes elsewhere, would say that after 13 years of unconsciousness with the best experts saying there's no alternative, surely morality makes room for that kind of treatment to be removed. That's what the law says. That's what ethics says, and, by the way, it's what most of our major faith traditions say.

The legal battle is being closely followed nationwide by partisans on both sides of the right-to-die issue. Kenneth Goodman, who heads the University of Miami's bioethics program, called Thursday's ruling ``an antidote to legislative civil disobedience.''
''Nobody who knows how law is supposed to work in a free and open society is surprised by this'' decision, Goodman said.
Goodman, who has followed the case closely and offers historical information on the case at the ethics' program's website, calls Terri's Law ``one of the darkest days of the Florida Legislature.''
Goodman said that lawmakers cynically injected themselves into a family's tragedy in order to score votes with a well-organized movement.

Dr. Kenneth Goodman
Kenneth W. Goodman, Ph.D., is founder and director of the University of Miami's Bioethics Program. He holds appointments in the university's Department of Medicine, Department of Philosophy, Department of Epidemiology and Public Health, and School of Nursing. He shares responsibility for ethics education of UM students, trainees, and faculty. His research has focused on ethical issues in medical informatics, including bioinformatics or computational genomics, and in epidemiology and public health. Recent work has emphasized end-of-life issues, especially in conjunction with the Florida Partnership for End-of-Life Care, a Robert Wood Johnson Foundation funded initiative to improve care of the dying. Goodman is a PI along with colleagues at the University of Florida and other institutions in this statewide effort.
Dr. Goodman collaborates with a broad variety of institutional ethics committees and review boards, providing education, policy review and consulting services. The university's Bioethics Program produces an annual ethics conference ("Clinical Ethics: Debates, Decisions, Solutions") which is in its 9th year and which has emerged as one of the largest (if not the largest) community ethics conference in the nation.

The Supreme Court has denied hearing Terri's Case!!! The only option is the Executive powers of State of Florida and Federal. The hands of the Chief Executive of the State of Florida (Governor, law enforcement, etc.) and Federal (President of the U.S.A., law enforcement) will be aiding and abetting murder if they do not put Theresa Schiavo into protective custody and begin investigations.

Law Protecting Terri Schiavo

(CNSNews.com) - The Florida judge presiding over the
Terri Schiavo case ordered the state agency charged
with protecting vulnerable adults to make no attempt
to take the brain-injured woman into protective
custody late Wednesday. The order appears to be in
direct contradiction to a state statute that requires
the agency to act.
Mayo Clinic neurologist Dr. William Cheshire -- who is
also a member of the Florida's Adult Protective
Services team -- said late Wednesday that Terri
Schiavo "may have been misdiagnosed" by one court
appointed doctor and two other physicians chosen by
Michael Schiavo.
Those three doctors declared Terri to be in a
persistent vegetative state (PVS), but Cheshire said,
based on his examination of Terri and review of her
records, she is more likely in a minimally conscious
state (MCS). The term is a new diagnostic description
that has come into acceptance since Terri was last
examined.
Florida Gov. Jeb Bush said the new information "raises
serious concerns and warrants immediate action.
"Terri is now going on her sixth day without food or
water," Gov. Bush told reporters Wednesday afternoon.
"It is imperative that she be stabilized so that the
adult protective services team can fulfill their
statutory duty and thoroughly review all the facts
surrounding her case."
One member of the media asked if the state Department
of Children and Families (DCF) planned to take Terri
Schiavo into protective custody, remove her from the
hospice where she is being dehydrated and starved to
death or try to reinsert her feeding and hydration
tube.
"We are looking at every potential opportunity to be
of assistance," replied DCF Secretary Lucy Hadi.
That response apparently prompted the attorney for
Terri's estranged husband and legal guardian, Michael
Schiavo, to contact Pinellas County Circuit Court
Judge George Greer, requesting a court order barring
the state from acting. Noted "right-to-die" attorney,
author and activist George Felos argued during a court
hearing later Wednesday that DCF had "no more power
than ... a person walking down the street," to place
Terri in protective custody.
"Any action would be a violation of Mrs. Schiavo's
constitutional right to refuse medical treatment. It
would be a violation of her civil rights. It would be
an assault, a battery, a trespass on her," Felos
argued, following his assessment with a threat aimed
at DCF officials, "and, should that occur and should
that be attempted, we will hold those to the fullest
extent of the law."
But Florida statute
2004-Ch0415-Section%201051#0415.1051"415.1051 seems to
contradict Felos' claim.
The statute states, "If it appears that the vulnerable
adult ... is likely to incur a risk of death or
serious physical injury if such person is not
immediately removed from the premises, then the
representative of the department shall transport or
arrange for the transportation of the vulnerable adult
to an appropriate medical or protective services
facility in order to provide emergency protective
services."
Jennifer Lima-Smith, an attorney for the DCF, reminded
Greer that the agency does not need his permission in
advance to act.

"The law allows the department to exercise both
emergency protective services -- intervention and
emergency removal -- either one or both," Lima-Smith
told Greer.
The statute also appears to specifically exempt DCF
from an otherwise enforceable mandate to seek Michael
Schiavo's permission to remove Terri.
"If the vulnerable adult's caregiver or guardian is
present, the protective investigator must seek the
caregiver's or guardian's consent ... before the
vulnerable adult may be removed from the premises,"
the law states, "unless the protective investigator
suspects that the vulnerable adult's caregiver or
guardian has caused the abuse, neglect, or
exploitation."
The only authorization or requirement for the
involvement of the courts in an emergency intervention
or removal comes after DCF has taken its action. "The
department shall, within 24 hours after providing or
arranging for emergency removal of the vulnerable
adult, excluding Saturdays, Sundays, and legal
holidays, petition the court for an order authorizing
emergency protective services."
Nonetheless, Greer rebuked the agency, ordering it not
to attempt to enforce the state law.
"Since it appears imminent that the department is
likely to do something in contravention of that rule
of law, this court is going to grant the oral motion,"
Greer said. "DCF is hereby restrained from taking
possession of Theresa Marie Schiavo or removing her
from Hospice Woodside, administer (sic) nutrition or
hydration artificially or otherwise interfere (sic)
with this court's final judgment."
That final portion of Greer's oral order seems to
contradict yet another portion of the statute,
entitled "Emergency medical treatment.
"If, upon admission to a medical facility, it is the
opinion of the medical staff that immediate medical
treatment is necessary to prevent serious physical
injury or death, and that such treatment does not
violate a known health care advance directive prepared
by the vulnerable adult," the statute states, "the
medical facility may proceed with treatment to the
vulnerable adult."
Terri Schiavo has no such advance directive.
At approximately 11:00 p.m. EST, attorneys for Terri
Schiavo's parents filed a 40-plus page request for an
emergency injunction with the U.S. Supreme Court. The
pleading asks the justices to order Terri's feeding
and hydration tube reinserted while the lower federal
courts conduct a completely new trial of the facts in
the case. That review was mandated by special
legislation passed by Congress and signed into law by
President George W. Bush earlier in the week.

Ive lost faith in our Judicial System, simply for the fact that they
themselves can not determine a life from a food. They dont realize
that once, themselves, they have been in a state like Mrs. Terri
Schiavo. You were once in a state that you responded to stimuli but
could not talk. You were in your mothers womb. You are a daughter,
you are a son. You may or may not be a husband or wife.
Terri's Parents are the closest of Kin to her. They want
responsibility for their daughter, but because of court ruling she
cant get the adequit care that could improve her chances.
Terry is not a vegetable, she has movements, she makes noise, she
comprehends certain things. She responded to Stimuli. Terri was put
into a position that she will never be able to get out of because of
her husband and for the Judicial System of the United States.
Terri's husband should be investigated for attempted murder, and if
these court dont do what is right, soon should be looked at for
murder. There was evidence that she was reacting to something when a
nurse found insulin in the garbage. They did not act. They fired the
nurse.
The courts, which they wont, should place out an order that requires
a divorce. He obviously created bigamy and betrayed his wife.
God Created Everyone Equal. No, its apparent that he didnt. God
created murderers and people like her husband. He clearly doesnt want
her to be a live, and he doesnt want to go to "hell" for divorce, but
he still.
In god we Trust. Trust we dont. The United States has turned itself
into a mad house. A house that murder and masacre are "ok" because
shes a "vegetable", oh shes good as dead anyway, right? Wrong. Fact

I saw that at the Empire Journal yesterday afternoon.
It's becoming more and more obvious that all levels of government have abandoned this innocent lady. Disgusting is a mild description term of how I feel. Last night I was sobbing over the situation.
Certainly Jeb Bush has authority to pardon Terri. Similar power of authority might be available to George -- if he cared to utilize it. I 've been sending out text of Florida's Constitution section on pardons to radio hosts, etc. I'll be sending to WorldNetDaily later and hope an outcry and demand will ensue. Greer would not be able to do anything legally against Bush for use of the pardon option.

According to a few Members of the US House of Representatives, I was incorrect in my assertion on Wednesday that the bill signed into law early Monday morning (Public Law 109-3) simply gave Terri Schiavo's parents access to the Federal Courts and did not require the reinsertion of her feeding tube.
The "few Members" of the House of Reps include Speaker Dennis Hastert, Majority Leader Tom DeLay, Majority Whip Roy Blount, and Judiciary Committee chairman James Sensenbrenner as well as Florida Congressman Dave Weldon (who is an M.D.) submitted a "friend of the court" brief asserting the legislative intent of the law.
Their brief stated that Public Law 109-3, requires US District Court Judge James Whittemore to have Mrs. Schiavo's feeding tube reinserted pending the outcome of the federal court reviews.
The section of the brief in question reads, "Clearly, the Middle District of Florida is required by Public Law 109-3 to keep Theresa Marie Schiavo alive until such time as a de novo review of her claims occur."
According to the Findlaw.com legal dictionary, "de novo" means, "over again; as if for the first time."
When the Supreme Court, in a 33-word order, ruled unanimously that Mrs. Schiavo's feeding tube should not be reinserted, it rendered PL 109-3 moot, whatever the intention of the Congress was and whatever its Constitutionality.
But let's track back over this anyway.
Either PL 109-3 is Unconstitutional, meaning the Congress, under the doctrine of separation of powers, cannot require a Federal judge to issue a specific order in a specific case; OR Judge Whittemore chose to ignore a Constitutionally acceptable law, which might well qualify as bad behavior on his part.
Let's go to the rule book:
Article I, section 2 of the U.S. Constitution states that "The House of Representatives … shall have the sole Power of Impeachment."
Article I, section 3 states "The Senate shall have the sole Power to try all Impeachments."
Article III, section 1 states that Federal judges "shall hold their Offices during good Behavior," which is the basis of the lifetime appointment for Federal judges.
There is a concept in US Constitutional law of "Judicial Review" which has been in force since 1803 when Chief Justice John Marshall first asserted it in Marbury v Madison.
Judicial Review grants Federal courts the right - and responsibility - to (according to findlaw.com) "strike down an act of Congress as inconsistent with the Constitution."
My excellent memory of Dr. Robert Hill's Con Law class at Marietta College does not include in that doctrine, the Judiciary's authority to simply ignore a law which is otherwise Constitutional.
So,
If PL 109-3 is Constitutional; and
If the House was serious about the passage of PL 109-3; and
If the intent of the legislation was to have Mrs. Schiavo's feeding tube reinserted; and
If U.S. District Judge Whittemore willfully ignored PL 109-3; and
If a Federal judge can only continue to serve "during good behavior;" and
If defying a lawful statute is bad behavior; and
If the House of Representatives has "the sole power of impeachment;" then,
The House Judiciary Committee should immediately being impeachment proceedings against Judge Whittemore.
Whew!
I do not expect that the House will impeach Judge Whittemore and if they did, I would not expect that the US Senate would convict.
Articles of Impeachment have only been adopted by the House 62 times since 1789. Of the cases which went to a Senate trial only seven resulted in convictions. All seven, interestingly, were Federal judges.
The appalling case of Terri Schiavo and her family is coming to an end. It may not have lasting significance from a political standpoint, but its impact on the legislative/judicial relationship may echo for years to come.
